Federal appeals court puts pause on Sen. Graham's testimony in Trump election probe

A federal appeals court has temporarily blocked a lower court’s order requiring U.S. Sen. Lindsey Graham (R-SC) to testify before a special grand jury that’s probing possible illegal efforts to overturn President Joe Biden’s 2020 election win in Georgia, according to a recent report by FOX 5 Atlanta.

Graham was set to appear before the special grand jury last week.

The federal appeal court’s ruling comes after U.S. District Judge Leigh Martin May denied Graham’s request to suppress his subpoena earlier this month and later put her decision on hold while he appealed, prompting attorneys for the lawmaker to take their case to the 11th U.S. Circuit Court of Appeals.

Fulton County District Attorney Fani Willis first opened her probe early last year after details of a phone call then President Donald Trump made to Georgia Secretary of state Brad Raffensperger, where he requested he “find” the votes needed to overturn the election, became public, FOX 5 reports.

According to the report, Willis and her team have insisted they want to question Graham about two phone calls they say he made to Raffensperger and his staff shortly after the 2020 general election, during which he reportedly inquired about "reexamining certain absentee ballots cast in Georgia in order to explore the possibility of a more favorable outcome for former President Donald Trump."

While the lower court’s order was blocked, FOX 5 reports May said the clause does not protect actions that are political rather than legislative meaning there could still be areas of potential testimony related to the investigation which Graham could be questioned on even if the calls were "comprised entirely of legislative factfinding.”
