U.S. Sen. Lindsey Graham is seeking to challenge a subpoena in federal court after he was ordered to testify before a special grand jury about whether former President Donald Trump and others broke e law by attempting to overturn President Joe Biden's win in the state.
Graham, a Republican with close ties to Trump, Graham received the subpoena on July 26 to appear before the special grand jury on Aug. 23, his lawyers said in a court filing, according to FOX 5 Atlanta.
The senator wants the challenge to be heard before Atlanta's federal court rather than before the Fulton County Superior Court judge who’s overseeing the special grand jury, FOX 5 reported.

Graham is just one of many Trump associates who Fulton County District Attorney Fani Willis hopes to question in her investigation into what she calls a “multi-state, coordinated plan by the Trump Campaign to influence the results of the November 2020 election in Georgia and elsewhere.”
Willis referenced at least two telephone calls made by Graham to Georgia Secretary of State Brad Raffensperge and members of his staff in the weeks following Trump’s loss to Biden in a court filing last month. In these, he asked about re-examining certain absentee ballots, aiming to “explore the possibility of a more favorable outcome for former President Donald Trump."
As lawyers for the senator claim Willis failed to demonstrate the “extraordinary circumstances” in place to order such a high-ranking federal officer to testify, the district attorney's office expects Graham to testify before the special grand jury.
